By using this site or the services provided by European Refrigeration Limited you agree to the following Terms and Conditions. We reserve the right to make changes at any time to these Terms and Conditions, which will be published in the text on this site.

Products

Images of products on this site are as a guide only and the delivered product may vary.  Particulars of dimensions, capacities, performance ratings, specifications, etc., included in manufacturers’ documentation are an approximate guide and shall not be binding upon European Refrigeration ltd.

Pricing

Prices are correct at time of publishing. European Refrigeration Limited reserves the right to amend prices at any time and without prior notice. All prices are subject to VAT at the standard rate.  All prices are in £ sterling and exclusive of VAT and delivery and are based on being paid via Bank Transfer, BACS or CHAPS, or Cheque and are not available on account. Prices, offers and products are subject to availability and may change and any savings shown are based on the manufacturer’s list price.

Ordering

Orders can be placed via the following methods:

24-hour Web Order – orders placed after 17:00 may not be dealt with until 09:00 the following business day

24-hour Fax / Email Order - Send details of your order or official purchase order via fax to 01268 590199, or email: service@erl-info.co.uk.

The minimum age requirement to place an order is 18, by placing an order you confirm you are of the required age.

Payment Options

Payment can be made via:

Bank transfer BACS, CHAPS

Cheque

Credit Card.  (We do not accept credit card payments on line, but we do accept them over the phone).  A fee of 3% will be charged.

Online orders will receive a pro forma invoice with details of how to pay. Once this payment has been cleared an invoice will be raised and sent by email. Please note all customers, including account holding customers, will be sent a pro forma invoice for any goods advertised on our website and payment is required before any goods can be supplied. If you wish to pay by cheque please ring 01268 590198.

Delivery

Delivery is restricted to the United Kingdom (excluding Northern Ireland). All islands, highlands and remote area deliveries will be subject to additional charges for delivery, please contact the sales office on 01268 590198 to confirm what this charge will be prior to the order being placed.

Whilst European Refrigeration Limited has taken all reasonable care in the preparation of the contents of their website; some information has been supplied by third parties and is reproduced in good faith. European Refrigeration Limited disclaims (to the extent permitted by law) all warranties, express or implied, as to the accuracy of the information supplied by third parties or for apparent errors and omissions. Although European Refrigeration Limited chooses content providers and advertisers carefully it has no control over some of the content (such as advertising). If, however, you do see anything that offends please contact us and European Refrigeration Limited will attempt to rectify the problem.

European Refrigeration Limited does not guarantee that the use of this website will be compatible with all hardware and software that may be used by visitors to the site. European Refrigeration will not be liable for damage to, or viruses that may affect your computer equipment, software, data or other property as the result of your access to, use of or browsing of this website or your downloading of any materials, data, text or images.

Law & Jurisdiction:

Any disputes arising in connection with the use of this website will be governed by English law and will be subject to the exclusive jurisdiction of the courts of England and Wales.

GENERAL

Accepting Orders and Security

When you place an order  for Goods or Services, we will treat it as an offer to buy. However, we will be entitled to refuse to accept your order if we feel it necessary, in which case you will be advised by email.

In deciding whether to accept your order we may use the information you have given to us, or we already hold about you, to confirm your identity. This assists us to protect you and us from fraudulent transactions.

You agree that European Refrigeration Limited reserves the right to use a credit reference agency to verify credit history for your company and/or yourself as an individual if a sole trader.

Faulty Products & Warranties

Faulty products will be covered by the manufacturer’s warranty supplied with the item via the manufacturer or master UK distributor not European Refrigeration Limited.

Responsibility for this warranty is held with the manufacturer or master UK distributor, though this does not affect your statutory rights.

In this instance, a repair of the item will take place by the manufacturer or authorised agent of the manufacturer. Any call-outs that are caused by user error or misuse will be chargeable to the customer.

All warranties are only applicable for mainland UK.

For all non-warranty repairs, replacement parts have a warranty of 3 months, labour and call-out is chargeable at the current rate.  Any spare parts not fitted by ourselves are supplied without warranty.

Parts or equipment supplied remain the property of European Refrigeration Limited until any amount owed by the customer has been paid in full.

Any quotation for the repair of non-warranty equipment is regarded as a fixed price quotation for both parts and labour. All quotes are valid for 30 days unless specified otherwise.

Delivery/Collection

European Refrigeration ltd will use all reasonable endeavours to meet delivery dates/times, but cannot be held liable for any loss or damage if these are not met for any reason whatsoever.  Normal delivery times are between 8.30 a.m. and 6 p.m. (subject to location).

All deliveries must be signed for and your and receipt kept.  Please ensure all items are checked thoroughly before signing for your order.  If there is damage to the outer packaging, please ensure the courier signs to this effect.  If upon opening a product is found to be faulty, you must notify us within 48 hours.  Refunds can only be given for faulty or damaged goods.

Delivery of equipment as standard is at kerbside to a ground floor site with clear access. It is the customer’s responsibility to ensure all items fit onto the premises through doors stairs etc. If upon arrival at site deliveries cannot be completed due to site restrictions, the customer will be responsible for any resultant costs, including hire of specialist equipment/additional man power, re-delivery fee, re-stocking fee.

Unpacking, positioning of products and disposal of old units is not available on all products. If you are interested in using this service please check that your product includes this as an option before ordering. Collection of old equipment as standard is at kerbside to a ground floor site, with clear access. Normal times are between 8.30am and 6pm. If collection requires deviation from the standard practise please call the sales office on 01268 590198 to arrange special arrangements, if possible, for an additional fee. European Refrigeration Limited has the right to reject any collection outside of standard practises should they wish.

Cancellations and Returns

This returns policy does not affect your statutory rights.

All returns are subject to authorisation by European Refrigeration Limited and the manufacturer.  European Refrigeration Limited is under no obligation to accept returns of unwanted or unsuitable goods.  Any goods pending return must be unused and still in their original packaging.  

Goods must be returned complete with all parts, components, accessories and manuals.  A charge will be made to replace any missing parts.

Any cost for the return of goods will be at the expense of the customer.  In all cases returned goods will be subject to a re-stocking charge (amount to be confirmed at time of return) plus VAT.  

Please Note: Any ‘special order’ items that are direct from the manufacturer cannot be cancelled or returned once ordered.

Electrics

It is the Clients responsibility to ensure all electrics comply with current legislation and that a suitable connection point is provided for the equipment being supplied or installed by ourselves.

Payment

Our payment terms are as detailed on our quotation or as detailed above for products ordered via our website.

Payment can be made by BACS/CHAPS, cheque or credit card (via the phone).

Please note that any overdue invoices may be subject to interest charged in accordance with the provisions contained in the Late Payment of Commercial Debts Regulations 2013.  We reserve the right at any time to withdraw all credit facilities and demand immediate settlement of all outstanding monies.

Limitation of Liability

European Refrigeration Limited cannot be held responsible for any losses or damage suffered by the customer, including consequential loss, loss of business, business interruption or loss of time due to the use or purchase of the goods by the customer, third party claims.  Furthermore, European Refrigeration Limited will not be liable for any additional damage caused due to the customer’s failure to report a fault or defect in good time or failure to provide reasonable access to the goods for service or repair.  It is the customer’s responsibility to be fully aware of all current legislation regarding catering equipment and its application/installation and sizes, we cannot be held responsible for any problems/costs arising from non-awareness. Should you need advice on current legislation surrounding catering equipment or require clarification, please contact the sales office.

Law and Jurisdiction

These Terms and Conditions are governed by English law and the parties shall be subject to the exclusive jurisdiction of the English courts.

Environmental Responsibility

We acknowledge that European Refrigeration Limited has an accountable impact on the environment and as such we work to reduce this wherever possible, our key aims being:

To comply with all relevant environment legislation and industry codes of practice.

To reduce environmental impact and prevent pollution in the formulation of our products and the operation of our importing and distributing processes.

To set objectives and targets to drive continual improvement plans and regularly review environmental performance

As a key part of our environmental policy we practice the principles of the 3 'R's.
